1. Agreement to Terms
Welcome to dubai-rent-yacht.com. By accessing our website, booking a yacht charter, or using any of our services, you agree to be bound by these Terms of Service ("Terms"). These Terms constitute a legally binding agreement between you ("Client," "you," or "your") and dubai-rent-yacht.com ("Company," "we," "us," or "our").
If you do not agree to these Terms, you must not use our services or make any bookings. By completing a booking, you confirm that you have read, understood, and accepted these Terms in their entirety.
2. Service Description
dubai-rent-yacht.com operates as a luxury yacht rental company in Dubai, United Arab Emirates. We provide:
- Private yacht charter services for various occasions (birthdays, corporate events, romantic cruises, fishing trips, etc.)
- Owner-direct fleet of 70+ premium yachts ranging from 27ft to 184ft
- Licensed captain and crew for all charters
- Optional add-on services (catering, decorations, water sports, entertainment, photography, transportation)
- Customizable routes and itineraries within Dubai waters
All services are subject to availability, weather conditions, and compliance with UAE Maritime Authority regulations.
3. Booking Process and Confirmation
3.1 Booking Requirements
To make a booking, you must:
- Be at least 18 years of age
- Provide accurate and complete information (name, contact details, guest count, event type)
- Have the legal authority to enter into this agreement
- Accept full responsibility for all guests in your party
3.2 Booking Confirmation
A booking is confirmed only when:
- You have selected a yacht, date, time, and duration
- You have paid the required deposit (50% of base charter rate)
- You have received written confirmation via email or WhatsApp from our team
- Confirmation includes: yacht name, date, time, duration, pickup location, total cost breakdown
Unconfirmed bookings or verbal agreements do not constitute a valid reservation.
3.3 Availability
All bookings are subject to yacht availability. We reserve the right to decline any booking request at our sole discretion. In the event a yacht becomes unavailable after confirmation (due to unforeseen mechanical issues or other circumstances), we will:
- Offer a comparable or superior yacht at the same rate
- Provide a full refund if no suitable alternative is available
- Notify you immediately via WhatsApp or phone
4. Pricing and Payment Terms
4.1 Pricing Structure
Our pricing is transparent and includes:
- Base Charter Rate: Hourly rate × charter duration (minimum 2 hours for most yachts)
- Included in Base Rate: Licensed captain and crew, fuel for standard routes (≤25 nautical miles), unlimited soft drinks and water, towels, ice, premium sound system, full insurance coverage, safety equipment
- Optional Add-ons: Quoted separately and paid 100% upfront (catering, alcohol, decorations, water sports, DJ/entertainment, photography, luxury transportation)
4.2 Duration Discounts
We offer the following discounts based on charter duration:
- 3-4 hours: 10% off base rate
- 4-6 hours: 15% off base rate
- 6-8 hours: 20% off base rate
- 8+ hours: 30% off base rate
4.3 Payment Schedule
- Deposit: 50% of base charter rate due at booking to secure reservation
- Add-ons: 100% payment required at time of ordering (minimum 48 hours before charter)
- Balance: Remaining 50% of base rate due upon arrival at marina before boarding
4.4 Accepted Payment Methods
We accept the following payment methods with no additional fees:
- Visa and Mastercard (credit/debit cards)
- Bank transfer (UAE bank accounts)
- Cash (AED or USD) at marina
4.5 Additional Charges
Additional charges may apply for:
- Extended Routes: Fuel surcharge for routes exceeding 25 nautical miles (quoted per additional mile)
- Overtime: If charter extends beyond booked duration, hourly rate applies (subject to yacht availability and captain approval)
- Damage or Loss: Costs for repair or replacement of damaged/lost yacht property (see Section 8)
- Excessive Cleaning: AED 500-1,500 for cleaning beyond normal wear (vomit, spills, stains)
4.6 Currency
All prices are quoted in UAE Dirhams (AED). If paying in another currency, the exchange rate on the day of payment applies.
5. Cancellation and Refund Policy
5.1 Client-Initiated Cancellations
- 48+ hours before departure: Free cancellation with full deposit refund (processed within 3 business days)
- 24-48 hours before departure: 50% cancellation fee; 50% of deposit refunded
- Less than 24 hours before departure: 100% cancellation fee; no refund
- No-show: 100% charge; no refund
Cancellation requests must be submitted in writing via WhatsApp or email. Verbal cancellations are not accepted.
5.2 Weather-Related Cancellations
If the UAE Coast Guard issues a weather warning or our captain deems conditions unsafe (high winds, rough seas, poor visibility), the charter will be cancelled. In this case, you will receive:
- Option 1: Free rescheduling to another date (subject to availability)
- Option 2: Full refund of all payments (processed within 3 business days)
Weather assessments are made 24 hours and 2 hours before departure. The captain has final authority on safety decisions.
5.3 Company-Initiated Cancellations
We reserve the right to cancel a charter due to:
- Mechanical failure or safety concerns with the yacht
- Force majeure events (natural disasters, government restrictions, etc.)
- Client violation of these Terms or unsafe behavior
In such cases, we will offer a comparable yacht or full refund. We are not liable for consequential damages or expenses (travel costs, lost time, etc.).
5.4 Modification of Bookings
Changes to confirmed bookings (date, time, yacht, guest count) are subject to availability and must be requested at least 48 hours in advance. Modifications may incur price adjustments based on new selections.
6. Charter Day Procedures
6.1 Check-In and Boarding
- Arrive at the specified Dubai Marina berth 15 minutes before departure time
- Present valid government-issued ID (passport or Emirates ID) for all adults
- Complete final payment (if balance is due)
- Attend mandatory safety briefing conducted by captain
- Board yacht via red-carpet entrance
Late arrival may result in reduced charter time. Departure time cannot be extended without prior arrangement and additional payment.
6.2 Guest Count
The number of guests must not exceed the yacht's maximum capacity as stated in your booking confirmation. Exceeding capacity is a safety violation and may result in:
- Refusal to board excess guests
- Cancellation of charter without refund
- Legal liability for safety violations
Children and infants count toward total guest capacity.
6.3 Route and Itinerary
Standard routes include Dubai Marina, JBR, Palm Jumeirah, Atlantis, and Burj Al Arab. Custom routes within 25 nautical miles are included. The captain reserves the right to modify the route due to:
- Weather conditions or sea state
- Maritime traffic or restricted areas
- Safety concerns
- Time constraints
6.4 Swim Stops
Swim stops are available on charters of 4+ hours, subject to:
- Weather conditions (wave height under 0.5m, wind under 15 knots)
- Daylight hours
- Captain's safety assessment
Swim stops are not guaranteed and cannot be grounds for refund if conditions are unsafe.
7. Client Responsibilities and Conduct
7.1 Safety Compliance
All guests must:
- Follow captain and crew instructions at all times
- Attend and comply with safety briefing
- Wear life jackets when required (mandatory for children under 9)
- Remain seated while yacht is in motion (unless otherwise instructed)
- Not interfere with yacht navigation or equipment
7.2 Prohibited Activities
The following activities are strictly prohibited and may result in immediate termination of charter without refund:
- Illegal drug use or possession
- Excessive alcohol consumption leading to intoxication or disruptive behavior
- Smoking in interior cabins (smoking allowed on open deck only)
- Jumping or diving from yacht without captain approval
- Operating yacht equipment or controls
- Bringing pets or animals without prior written approval
- Fishing without proper equipment and licenses (fishing charters only)
- Disrespectful or abusive behavior toward crew
- Any activity that endangers safety or violates UAE law
7.3 Alcohol Policy
Clients may bring their own alcohol (BYO) at no additional charge. However:
- Guests must be 21+ years to consume alcohol
- Excessive consumption leading to intoxication is prohibited
- Captain may refuse boarding to visibly intoxicated guests
- We reserve the right to terminate charter if alcohol-related misconduct occurs
7.4 Children and Minors
- Children of all ages are welcome
- Children under 9 must wear life jackets at all times (provided onboard)
- Parents/guardians are fully responsible for supervising minors
- High chairs available on yachts 60ft+ (request at booking)
8. Damage and Liability
8.1 Client Liability for Damage
You are responsible for any damage to the yacht or its equipment caused by you or your guests, including:
- Broken furniture, fixtures, or décor
- Stains or damage to upholstery, carpets, or linens
- Lost or damaged safety equipment
- Damage to sound system, electronics, or navigation equipment
Damage costs will be assessed and charged to your payment method. Disputes may be resolved through photographic evidence and third-party assessment.
8.2 Company Insurance
All yachts are fully insured with AED 5,000,000 liability coverage. This insurance covers:
- Yacht hull and machinery damage (not caused by client negligence)
- Third-party liability for accidents during charter
- Crew and passenger injury (within policy limits)
8.3 Personal Belongings
We are not responsible for loss, theft, or damage to personal belongings brought onboard. Guests are advised to:
- Keep valuables secure or leave them ashore
- Not bring excessive cash or jewelry
- Supervise personal items at all times
8.4 Medical Emergencies
Our crew is trained in basic first aid and CPR. In case of medical emergency:
- Crew will administer first aid and contact emergency services
- Charter will return to marina immediately
- You are responsible for all medical costs and emergency transport
- We recommend guests have travel/health insurance
Important Medical Disclaimer
Guests with pre-existing medical conditions (heart disease, pregnancy, mobility issues, seasickness susceptibility) should consult a physician before booking. Inform our team of any medical concerns at time of booking.
9. Limitation of Liability
To the fullest extent permitted by UAE law, dubai-rent-yacht.com and its owners, officers, employees, agents, and affiliates shall not be liable for:
- Personal injury, illness, or death resulting from your own negligence or failure to follow safety instructions
- Loss or damage to personal property
- Indirect, incidental, consequential, or punitive damages
- Delays or cancellations due to weather, mechanical failure, or force majeure
- Disappointment or dissatisfaction with subjective aspects of experience (e.g., weather, sea conditions, views)
Our maximum liability for any claim shall not exceed the total amount paid by you for the charter.
10. Force Majeure
We are not liable for failure to perform our obligations due to circumstances beyond our reasonable control, including but not limited to:
- Natural disasters (storms, earthquakes, floods)
- Government actions or restrictions
- War, terrorism, or civil unrest
- Pandemics or health emergencies
- Strikes or labor disputes
- Utility failures or infrastructure damage
In force majeure events, we will offer rescheduling or refund as outlined in Section 5.
11. Photography and Media Release
By booking with us, you grant dubai-rent-yacht.com permission to:
- Take photographs or videos during your charter for promotional purposes
- Use such media on our website, social media, marketing materials, and advertisements
- Share images without compensation or prior approval
If you do not wish to be photographed, inform the crew at the start of your charter. We will respect your privacy and exclude you from promotional content.
12. Intellectual Property
All content on dubai-rent-yacht.com website, including but not limited to text, images, logos, yacht photos, design elements, and software, is the property of dubai-rent-yacht.com and protected by UAE and international copyright laws.
You may not:
- Copy, reproduce, or distribute website content without written permission
- Use our brand name, logo, or images for commercial purposes
- Scrape or harvest data from our website using automated tools
13. Privacy and Data Protection
Your personal information is collected and processed in accordance with our Privacy Policy. By using our services, you consent to data collection and processing as described in the Privacy Policy.
We do not sell or share your personal information with third parties except as necessary to provide services (payment processors, catering partners, etc.) or as required by law.
14. Dispute Resolution
14.1 Complaints and Issues
If you have a complaint or issue during your charter:
- Notify the captain or crew immediately so we can address it
- If unresolved, contact our customer service via WhatsApp or email within 24 hours
- Provide details, photos, or evidence to support your claim
We will investigate and respond within 5 business days.
14.2 Governing Law
These Terms are governed by the laws of the United Arab Emirates and the Emirate of Dubai. Any disputes shall be subject to the exclusive jurisdiction of Dubai courts.
14.3 Arbitration
For disputes involving amounts under AED 50,000, parties agree to attempt resolution through good-faith negotiation before pursuing legal action. If negotiation fails, disputes may be submitted to binding arbitration under Dubai International Arbitration Centre (DIAC) rules.
15. Amendments to Terms
We reserve the right to modify these Terms at any time. Changes will be posted on our website with an updated "Effective Date." Your continued use of our services after changes constitutes acceptance of the new Terms.
For bookings made before a Terms update, the Terms in effect at the time of booking shall apply.
16. Severability
If any provision of these Terms is found to be invalid or unenforceable by a court of law, the remaining provisions shall remain in full force and effect.
17. Entire Agreement
These Terms, together with your booking confirmation and our Privacy Policy, constitute the entire agreement between you and dubai-rent-yacht.com. They supersede all prior communications, agreements, or understandings (written or oral).
